1. Acceptance of Terms
By accessing or using Megawatt Market ("the platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform. These terms apply to all users, including guests, buyers, operators, and administrators.
2. Service Description
Megawatt Market is a two-sided marketplace connecting datacenter operators — who list and manage their available computing capacity, power, space, and connectivity — with companies searching for datacenter resources.
The platform provides a searchable directory, profile pages, an RFQ (Request for Quotation) messaging system, comparison tools, and operator management features. Megawatt Market acts solely as an introduction service and is not party to any commercial agreements made between operators and buyers.
3. Operator Responsibilities
As an operator listing your facility on Megawatt Market, you agree to:
- Ensure all listing information is accurate, complete, and up to date. False or misleading listings may result in suspension.
- Take full responsibility for the content of your listings, including technical specifications, certifications, availability, and pricing.
- Respond to RFQ inquiries in good faith and within a reasonable timeframe.
- Not list facilities you do not have authority to represent or manage.
- Promptly update or remove listings for facilities that are no longer available.
4. Buyer Responsibilities
As a buyer using Megawatt Market, you agree to:
- Submit only genuine business inquiries through the RFQ system. Do not use RFQs for spam, competitive intelligence gathering, or any non-legitimate purpose.
- Provide accurate information in your RFQ submissions to enable operators to respond appropriately.
- Not misrepresent your organization, capacity requirements, or intent.
- Respect the confidentiality of any pricing or operational information shared by operators in response to RFQs.
5. Acceptable Use
The following activities are prohibited on Megawatt Market:
- Submitting false, fraudulent, or misleading listings or RFQs
- Sending unsolicited bulk messages or spam through the RFQ system
- Attempting to reverse-engineer, scrape, or harvest platform data at scale
- Sharing your account credentials with third parties
- Using the platform to circumvent competitors or gather intelligence in bad faith
- Any activity that interferes with the normal operation of the platform
- Impersonating any person or organization
6. Disclaimers
Introduction service only. Megawatt Market provides a directory and introduction service. We are not party to any commercial agreements, contracts, or transactions made between operators and buyers. All commercial negotiations and agreements are the sole responsibility of the parties involved.
No warranty on listings. We do not verify the technical accuracy or completeness of operator-submitted listing data unless explicitly marked as "Operator-verified". PeeringDB-sourced listings are provided as-is from PeeringDB's public dataset (CC-BY 4.0).
Platform availability. We strive to keep the platform available but do not guarantee uninterrupted access. We are not liable for any loss resulting from temporary unavailability.
7. Account Suspension and Termination
We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in abuse, submit fraudulent content, or otherwise act in a manner detrimental to the platform or its users.
You may request deletion of your account at any time from your account settings. Account deletion requests are processed within 7 days, during which time you may cancel the request. See our Privacy Policy for details on data retention after deletion.
8. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms. For significant changes, we will provide notice through the platform.
